Breaking News: Delhi HC Stays FSSAI Order On ORS Labels, Gives Interim Relief to Kenvue’s ORSL

The Delhi High Court has granted interim relief to JNTL Consumer Health India, allowing the company to continue selling its ORSL-branded electrolyte beverages despite a recent directive from the Food Safety and Standards Authority of India (FSSAI). The FSSAI orders, issued on October 14 and 15, 2025, prohibited the use of ‘ORS’ in the branding of non-WHO compliant formulations, aiming to prevent misleading claims. Justice Sachin Datta’s bench directed that these FSSAI orders would not be enforced against JNTL until a formal representation filed by the company is reviewed and decided upon by the FSSAI. This decision allows JNTL to continue its sales while the regulatory body re-evaluates its stance on the contentious labeling issue.

India weighs sugar export approval for 2025-26 amid surplus stocks, lower ethanol diversion

India is currently considering whether to permit sugar exports for the 2025-26 marketing year. This deliberation comes after an unexpected increase in surplus sugar stocks, primarily due to a lower-than-projected diversion of sugar for ethanol production. Union Food Secretary Sanjeev Chopra noted that only 3.4 million tonnes of sugar were used for ethanol in 2024-25, significantly below the anticipated 4.5 million tonnes, contributing to higher domestic availability. With an estimated sugar output of 34 million tonnes against an annual consumption of 28.5 million tonnes for 2025-26, India faces a clear surplus. A ministerial committee is expected to meet next week to finalize the export permissions, balancing the needs of sugar producers with broader energy and agricultural policies.

Exporters urged to prepare for EU packaging standards

Exporters, particularly from regions like West Africa, are being strongly advised to prepare for stringent new European Union packaging standards, specifically the EU Regulation 2025/40 on packaging and packaging waste, and Regulation 2024/3190 concerning bisphenol A in food contact materials. This call to action emphasizes the need for accelerated implementation of Extended Producer Responsibility (EPR) schemes and the establishment of waste collection infrastructure to enhance recycling and sustainable waste management across the entire packaging value chain. Industry experts highlight that these new regulations will significantly influence global trade standards, prompting manufacturers to invest in packaging innovation and benchmark their practices against international best standards to ensure competitiveness and sustainability in a rapidly evolving regulatory landscape.
